A proposed DHS rule would end the 60-day window H-1B workers currently get after losing a job. It hasn't happened yet. Here's how to prepare if a return to India is on the table.
On the Table Right Now
The Department of Homeland Security published a proposed rule on September 10, 2026, that would eliminate the 60-day grace period H-1B workers currently get after losing a job.
The same change would reach beyond H-1B: H-1B1 visa holders from Singapore and Chile, E-3 visa holders from Australia, and workers on L-1, O-1, TN, E-1, and E-2 visas, along with their dependents.
NOT YET IN EFFECT
Senior Talent Is Already Moving
Staffing firm Xpheno's data, reported by Business Standard and Business Today, puts real numbers behind the shift. Senior professionals with 10-plus years of experience moving from the US to India rose from roughly 650 in 2023 to about 2,800 in 2025, nearly sevenfold. Senior hires into GCCs (Global Capability Centers, the in-house engineering and product teams multinationals run directly in India instead of outsourcing to a vendor) climbed from around 350 to 2,400 over the same stretch. Reporters tie the jump to the $100,000 H-1B fee increase, tightened H-1B rules since late 2025, and the proposed HIRE Act.
Inside India's GCC Boom
The NASSCOM-Zinnov India GCC Landscape Report 2026 counts Global Capability Centers employing roughly 2.36 million professionals. On the other hand, hiring also dropped by approx. 28%.
Same Title, Different Job
A US paycheck and an equivalent Indian job often share the same title but cover different scopes of work.
Delivery Manager is a standard career-ladder title in Indian IT services, carrying real P&L and budget ownership, at firms like TCS, Cognizant, and Accenture's India operations. Nothing in a typical US org chart maps directly onto it. Engineering Manager and Program Manager come closest, and neither usually carries the same account-level financial accountability.
Scrum Master’s job postings routinely blend the role with Project Manager duties, agile ceremony facilitation combined with schedule tracking and stakeholder reporting, a different job than the impediment-removal focus the title carries at most US product companies. Nobody's published a formal study measuring this. Agile practitioners talk about it constantly, which counts for something even without the citation.
Product Manager tells a similar story. Zinnov found fewer than 10 percent of over 900 India-based multinational GCCs even have a formal product management function, a legacy of GCCs being built as delivery and execution centers, not product-strategy owners. That's shifting as GCCs mature into what NASSCOM calls innovation hubs, but a Product Manager title inside a GCC still usually carries less strategic weight than the same title at a US product company.
How Decisions Get Made
Hofstede's research scores India's Power Distance at 77 against the US's 40. Hierarchy and top-down decisions are more normal here, and open disagreement with a manager in a meeting lands differently in India than in the US. Individualism flips the comparison.
The US sits toward the low-context end, where people say what they mean plainly. India sits toward the high-context end, where meaning often lives in what's implied rather than spoken outright. People who've worked across both cultures frequently describe a specific pattern: "yes" in an Indian professional setting can mean "I heard you" rather than "I agree" or "I will do it."
Neither culture has this right and the other wrong. A delivery style built entirely on direct, low-context, flat-hierarchy habits will misfire in a high-power-distance, high-context room, and closing that gap is something learned, not an instinct anyone starts with.
